Article 1 — Identity of the trader

Article 2 — Applicability

2.1 These terms and conditions apply to every offer made by Scalp Collectors Group and to every distance contract concluded between the trader and the consumer.

2.2 Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the trader will indicate that the terms and conditions can be inspected and that they will be sent free of charge as soon as possible upon request.

Article 3 — The offer

3.1 Every offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.

3.2 All products of Scalp Collectors Group are limited releases. Availability is not guaranteed after the closure of a drop window. Restocks are not offered.

3.3 Obvious mistakes or errors in the offer do not bind the trader.

Article 4 — The contract

4.1 The contract is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the conditions set out therein.

4.2 The trader will confirm to the consumer no later than upon delivery of the product:

  • The address of the trader's establishment where the consumer can lodge complaints;
  • The conditions under which and the manner in which the consumer can exercise the right of withdrawal;
  • Information about guarantees and after-sales service;
  • The price including all taxes.

4.3 The trader may, within legal limits, verify whether the consumer can meet their payment obligations, as well as all facts and factors relevant to a responsible conclusion of the distance contract.

Article 5 — Right of withdrawal

5.1 The consumer has the right to dissolve the contract without giving reasons within a cooling-off period of 14 calendar days after receipt of the product.

5.2 Exception for made-to-order products: Pursuant to Section 6:230p(f)(3) of the Dutch Civil Code in conjunction with Article 16(c) of EU Consumer Rights Directive 2011/83/EU, the right of withdrawal does not apply to products manufactured according to the consumer's specifications or that have a clearly personal character. All Scalp Collectors Group products are produced on demand via Printful (print-on-demand), meaning the right of withdrawal does not apply.

5.3 Exception to the exception: in the case of defects, incorrect delivery, or non-conformity, the consumer may always invoke their statutory warranty rights pursuant to Section 7:17 of the Dutch Civil Code.

Article 6 — Conformity and warranty

6.1 The trader guarantees that the products and/or services comply with the contract, the specifications stated in the offer, the reasonable requirements of soundness and/or fitness for purpose, and the statutory provisions and/or government regulations existing at the time of conclusion of the contract.

6.2 In the event of defects or incorrect delivery, the trader requests the consumer to contact scalpcollectorgroup@proton.me with their order number and photographic evidence of the defect, within 14 days of receipt.

6.3 Any guarantee provided by the trader, manufacturer, or importer does not affect the statutory rights and claims that the consumer may assert against the trader under the contract.

Article 7 — Delivery and execution

7.1 The trader will exercise the greatest possible care in receiving and executing orders for products.

7.2 Products are manufactured via Printful (print-on-demand). Production time is typically 2–5 business days, followed by shipping. Delivery times are indicative and not binding deadlines.

7.3 The place of delivery is the address communicated by the consumer to the trader.

7.4 The risk of damage and/or loss of products rests with the trader until the moment of delivery to the consumer or a designated representative, unless expressly agreed otherwise.

Article 8 — Payment

8.1 Unless otherwise agreed, amounts owed by the consumer must be settled using the payment methods offered via the Shopify checkout system.

8.2 The consumer has the obligation to promptly report any inaccuracies in provided or stated payment details to the trader.

Article 9 — Complaints procedure

9.1 Complaints about the execution of the contract must be submitted to the trader fully and clearly described within a reasonable time after the consumer has identified the defects, via scalpcollectorgroup@proton.me.

9.2 Complaints submitted to the trader will be answered within 14 days of receipt. If a complaint requires a foreseeably longer processing time, the trader will respond within 14 days with an acknowledgement and an indication of when a more detailed response can be expected.

9.3 Consumers can access out-of-court dispute resolution via the EU ODR platform: ec.europa.eu/odr.

Article 10 — Disputes

10.1 Contracts between the trader and the consumer to which these terms and conditions apply are exclusively governed by Dutch law.

10.2 Disputes arising from or connected to the contract may be submitted to the competent court in the district of the trader's place of establishment.
